1. Validity
1.1 These General Terms and Conditions of Business (hereinafter referred to as “T&Cs”) apply to all sales contracts concluded between mey Handels GmbH and its affiliated companies (hereinafter referred to as ”mey”) and you as the customer, if you are a consumer.
1.2 A consumer, as defined in Section 13 of the German Civil Code, is any natural person who enters into a legal transaction for purposes that are not primarily associated with business or professional self-employment activity.
2. Conclusion of contract
2.1 Sales contracts between you and mey can be concluded via the mey online shop, by telephone or in person at mey sales locations.
2.2 Conclusion of contract via the mey online shop
(1) The presentation of goods in the mey online shop does not represent a binding offer.
(2) By placing an order – by clicking the “Buy now” button – you are making a binding offer to purchase. mey will send you an automatic order confirmation by email, which will reconfirm the details of the order. This automatic order confirmation serves only to confirm that mey has received your order, and does not represent its acceptance of your offer to purchase.
(3) A contract is concluded only when mey has confirmed the dispatch of the goods in a separate email, or upon dispatch of the goods.
(4) If the goods that you have ordered cannot be delivered, for example due to the goods in question being out of stock, mey will not issue confirmation of acceptance. In such cases, no contract is concluded. mey will inform you of any such inability to deliver without delay, and will immediately refund any payment already made for the goods.
2.3 Conclusion of contract at mey location or by telephone
A sales contract between you and mey can also be concluded in person at a mey sales location or by telephone. In such cases, the offer to conclude a sales contract is made by you. If mey accepts this offer, a legally binding sales contract is concluded between you and mey.
2.4 If you have a customer account in the mey online shop, you can view your order data under “My account” in the mey online shop. In all other cases, mey does not store a copy of the concluded contract separately. The contract concluded between you and mey in such cases is contained within the text of the order confirmation sent by email, the confirmation of acceptance or the email sent upon successful conclusion of the contract.
3. Right of Withdrawal
3.1 As a consumer making a purchase via the mey online shop, the online sales platform or by telephone, you have the right to withdraw from the contract as outlined below.
3.2 Exclusions
The right of withdrawal does not apply to contracts concluded for the supply of goods that are not ready-made and that are manufactured with options selected by the consumer or that have been clearly tailored to the personal requirements of the consumer.

4. Retention of property rights, offsetting and withholding rights
4.1 The delivered goods remain the property of mey until full payment is received.
4.2 You have no right to offset sums owed to us against any counterclaims, unless your counterclaims are legally binding or undisputed.
4.3 As a purchaser, you may only exercise withholding rights if your counterclaim is based on the same sales contract.
5. Delivery
5.1 mey reserves the right to make partial deliveries if this is acceptable to you.
5.2 The goods will be delivered to the address indicated by you. Unless otherwise agreed, the goods will be sent to you within two to four working days after conclusion of the contract and receipt of payment.
5.3 The risk of accidental damage or loss of the goods (transfer of risk) is transferred to you upon handover of the goods.
6. Prices/Delivery costs
6.1 The prices valid at the time of ordering apply. All prices are quoted as retail prices and include statutory VAT but exclude delivery charges and any transaction fees.
6.2 mey will provide details of the delivery costs payable before conclusion of the contract. For orders placed via the mey online shop, the total price including VAT, delivery charges and transaction fees will be displayed on the order screen before the contract is concluded.
6.3 Orders placed via a registered customer account are delivered free for orders over €50 of charge to Germany, and for orders over €100 of charge to the Netherlands, Belgium, Luxembourg, Austria and Ireland. Delivery to Germany without a customer account is charged at a flat rate of EUR 4.95. Delivery to the Netherlands, Denmark, Belgium, Luxembourg and Austria is charged at a flat rate of EUR 6.95 and delivery to Ireland and Sweden is charged at a flat rate of EUR 8.95.
7. Payment conditions/ payment methods
7.1 Unless otherwise agreed, the purchase price becomes due immediately upon conclusion of the contract. If payment is delayed, mey reserves the right to demand the payment of default interest at a rate of 5 percentage points above the base rate of the European Central Bank.
7.2 Generally, the payment methods listed below are accepted. mey reserves the right to perform a credit check and preclude the use of certain payment methods if necessary:
(1) Payment via PayPal
You pay the invoice amount via online payment provider PayPal. This method requires you to already be registered or prepared to register with PayPal, to log in using your credentials and then to confirm your payment instruction to mey. Once the invoice amount has been received in our account, the goods will be dispatched to you.
(2) Advance payment
With advance payment, you transfer the invoice amount to the mey account specified on the order confirmation. Once the invoice amount has been received in our account, the goods will be dispatched to you.
(3) Payment by credit card
To pay by credit card (VISA, Mastercard, American Express), you provide us with your credit card information. Once we have received your credit card information, the goods will be dispatched to you.
(4) Payment with Sofort.
When paying by instant transfer, you pay through the online service provider Sofort GmbH (A Klarna Group Company) with the login details for your online banking account. The sum is credited to Mey immediately after the transaction is executed. The goods are sent to you without waiting for receipt of payment.
(5) Payment viainvoice with Klarna
When paying via invoice with Klarna, you have 14 days from the day of billing to pay the total amount for your order. The invoice in enclosed in the package with your items.
(6) Payment via iDEAL
For payments via iDEAL, you transfer the invoice amount from your account with a Dutch bank online, during the ordering process.
7.3 If you provide inaccurate bank details and/or the amount cannot be collected from your account due to insufficient funds, mey reserves the right to charge a processing fee of EUR 10.00.
7.4 You agree to receive invoices/ delivery note electronically. Electronic invoices/ delivery note will be provided to you in PDF format via email.
8. Guarantee and liability
8.1 mey accepts liability for material defects and defects of title in accordance with the applicable legal regulations, particularly Section 434 et seqq. of the German Civil Code. The limitation period for legal defect claims is two years and commences upon delivery of the goods.
8.2 Claims for material defects are invalid if you modify the goods, handle the goods inappropriately or use the goods in any way that is not in line with their intended proper use.
8.3 mey reserves the right to make modifications to the shape, colour, weight and design of the products if such modifications and/or deviations, taking into account the interests of mey, are acceptable to you.
8.4 mey accepts unlimited liability for damage arising from any breach of guarantee or as a result of fatal or physical injury or damage to health. This provision also applies to wilful intent and gross negligence, statutory liability for product defects (under the Product Liability Act in particular) and to liability for fraudulent failure to disclose defects. In the event of minor negligence, mey accepts liability only if the breach relates to major obligations arising due to the nature of the contract and that are of particular importance to the achievement of the purpose of the contract. In the event of a breach of such obligations, a delay or an inability to fulfil the obligation, mey’s liability will be limited to the level of damage typically anticipated in the context of a contract of this type.
9. Data protection and credit checking
9.1 mey uses the personal data that you provide (such as your name, address, email address, telephone number and account information) in accordance with the applicable provisions of German data protection law.
9.2 All personal data is handled confidentially. The personal data required to process the transaction and other data provided voluntarily is stored by mey and processed and used to handle orders, manage the customer relationship, deliver goods, process payments and prevent defaults in payment; the data will be passed on to service partners contracted to assist mey in the fulfilment of orders if necessary (such as freight companies or credit institutions). The data will also be used for mey’s own advertising and marketing purposes, such as mailing written advertising material to customers. mey will use your email address to send you promotional offers unless you have asked not to be included in such mailings. If your consent is required to send you these offers, mey will request such consent in advance. We will only contact you by telephone to inform you of promotions if we have your express permission to do so. Further information on our data protection provisions is available here.
9.3 For online purchases, mey will honour the customer’s statutory right to withdraw from the contract. As part of the returns process, mey will collect and store data on the returned goods. To prevent excessively high levels of returns, mey analyses this data for the previous twelve-month period and will approach customers with a high returns rate to agree a solution that is satisfactory for both parties. mey reserves the right to prohibit customers with a high returns rate from making purchases via the mey online shop.
9.4 When making a purchase on account, you grant your consent for mey to perform an identity and credit check to prevent defaults in payment, which will involve passing the data provided by you during the ordering process, including your name, address and date of birth, to Creditreform Boniversum AG (hereinafter referred to as “Boniversum”), Hammfelddamm 13, 41460 Neuss, which will store your data in its capacity as a credit agency for the purpose of providing information. mey will receive information from Boniversum on your previous payment behaviour and credit information based on statistical mathematical calculations made using your data, including your address data. mey also reserves the right, to safeguard its legitimate interests or those of third parties, to pass data on your due and overdue debts to Boniversum if the conditions stipulated in Section 28a para. 1 of the German Federal Data Protection Act are satisfied, particularly if
(1) the claim is enforceable or you have acknowledged the claim;
(2) you have received at least two written reminders from mey since the due date of the claim, at least four weeks have elapsed between the first reminder and the provision of the data, mey has informed you that the data is to be passed on in good time but no earlier than with the first reminder, and you have not disputed the claim. mey will also pass on data on other conduct in breach of the contract (e.g. credit card misuse, fraud) to Boniversum if the passing on of such information is required to safeguard the legitimate interests of mey or third parties and there is no reason to believe that your legitimate interests justify the withholding of such information. You can obtain information on the data stored on you by Boniversum by contacting the agency at the address provided above.

to revoke your consent for the future use and processing of your data for our own advertising and marketing purposes, without incurring any costs other than the usual costs of communication at the basic rates, and to revoke any other consent provided in relation to the future use of your data. 10. Presentation
The delivered item may differ from the goods presented. We always strive to present our goods as accurately and realistically as possible, but colours may vary as a result of variations in monitor colour settings.
11. Author and brand protection
All author and brand rights for the used pictures, graphics, texts etc. belong to mey Handels GmbH. Any use of such items without express permission is not allowed.
12. Applicable law and place of fulfilment
12.1 The law of the Federal Republic of Germany applies.
12.2 The place of fulfilment is Albstadt.
13. Complaints process via online dispute resolution for consumers (OS)

We are neither required nor prepared to participate in dispute resolution proceedings managed by a consumer protection body.

On the product pages, you can initially add our products to the shopping cart without obligation. You can modify your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The available payment methods are listed during the checkout process.

14.4.1 Application of Harmonized Standards and Technical Specifications
Our online presence complies with:
- partially with the European Harmonized Standard (EN) 301 549. (EN) 301 549, titled "Accessibility requirements for ICT products and services," is a European standard for digital accessibility.
- partially with the Web Content Accessibility Guidelines (WCAG) version: 2.1. It meets level AA.
The WCAG are an international standard for accessibility guidelines, developed and maintained by the World Wide Web Consortium (W3C), the body responsible for standardizing web technologies. Mey GmbH endeavours to make its website accessible in accordance with the Barrierefreiheitsstärkungsgesetz (BFSG). The underlying technical requirements are based on EN 301 549 and the Web Content Accessibility Guidelines (WCAG) 2.1, conformity level AA.

The content listed below is not yet barrier-free for the reasons stated below:
- PDF documents: some of our PDF documents are not yet barrier-free. We are already working on adapting
these as quickly as possible or providing accessible alternatives where possible.
- Videos: Some of our embedded videos do not currently have subtitles. We are endeavouring to provide
subtitles for all our videos in the future.
- Images/graphics: Some images on our website do not yet have alternative text. We are constantly reviewing
and updating this content in order to be able to provide subtitles soon.

(4) Payment via Amazon Pay
If you already have an Amazon.uk customer account, you can pay immediately using the payment method you have on file for that account, either by direct debit or credit card. Click on the “Pay with Amazon” button and log into your Amazon account. Then select one of your delivery addresses and payment methods and confirm the order. Your bank account or credit card will only be charged once delivery of your order to your delivery address has been confirmed.
